Incumprimento de entrega e falta de reembolso pela loja Gato Preto

Senhores, Venho por este meio apresentar reclamação contra a loja Gato Preto, devido a uma situação de incumprimento contratual e falta de comunicação relativamente a uma encomenda efetuada há mais de dois meses. Em 26/07/2025, encomendei em loja um sofá, tendo pago o respetivo valor, incluindo entrega e montagem. Após sucessivas semanas de espera sem qualquer atualização, apenas quando entrei em contacto com a loja fui informada de que não havia stock disponível, facto que nunca me foi comunicado previamente. Considero esta situação absolutamente inaceitável, uma vez que o consumidor tem direito a ser informado de imediato em caso de falta de stock e a receber o reembolso integral do valor pago, conforme estabelecido no Decreto-Lei n.º 67/2003 e no artigo 801.º do Código Civil. Apesar de ter solicitado o reembolso total (incluindo entrega e montagem) e de ter disponibilizado o meu IBAN, a loja insistiu que teria de me deslocar fisicamente ao estabelecimento para resolver a situação, o que é manifestamente injustificado e desproporcionado, dado que o erro e o incumprimento são inteiramente da responsabilidade da empresa. Solicito, portanto, a intervenção da DECO no sentido de garantir: 1. O reembolso imediato e integral de todos os valores pagos; 2. O reconhecimento do incumprimento contratual por parte da loja; 3. Exmos. Senhores, Na sequência da reclamação que apresentei à DECO relativa à loja Gato Preto (Centro Colombo), venho informar que, apesar do vosso contacto, a situação continua por resolver. Na passada sexta-feira, dia 10 de outubro, recebi um telefonema da loja do Colombo, durante o qual me foi solicitado que enviasse por email o comprovativo do pagamento (ticket Multibanco) e que reencaminhasse todas as trocas de emails anteriores, o que fiz de imediato. Durante essa chamada, perguntaram-me inclusive se ainda queria receber o sofá, o que é no mínimo contraditório, tendo em conta que já me tinham informado anteriormente que o produto estava sem stock. Desde então, não obtive qualquer resposta ou confirmação de reembolso, apesar de todas as informações pedidas já terem sido enviadas. A situação arrasta-se há mais de dois meses, o que considero inaceitável e lesivo dos meus direitos enquanto consumidora. Reitero que o incumprimento do contrato é da exclusiva responsabilidade da loja, e volto a solicitar o reembolso total do valor pago (incluindo entrega e montagem), conforme previsto no Decreto-Lei n.º 67/2003 e no artigo 801.º do Código Civil. Na sequência da reclamação apresentada contra a loja Gato Preto (Centro Colombo), venho reforçar que a situação continua por resolver e que a loja tem vindo apenas a adiar o reembolso com respostas evasivas e inconclusivas. Desde que fui informada (porque eu mesma questionei a demora), há mais de duas semanas, de que o sofá encomendado afinal não existia em stock (depois de ter esperado 2 meses), tenho cumprido tudo o que me foi solicitado, enviei o comprovativo de pagamento, todas as trocas de emails e toda a documentação pedida. Apesar disso, a loja limita-se a enviar mensagens genéricas, alegando que “o processo está com o departamento financeiro”, sem nunca indicar uma data concreta nem efetuar o reembolso. É evidente que todas as respostas têm servido apenas para adiar uma obrigação que é da exclusiva responsabilidade da empresa, uma vez que o cancelamento resultou de falta de stock e não de qualquer desistência da minha parte. Esta situação é inaceitável e abusiva, e considero que a loja está deliberadamente a protelar o cumprimento do reembolso, obrigando o consumidor a sucessivos contactos sem qualquer resultado prático. Solicito, por isso, a intervenção urgente da DECO para garantir que o reembolso integral do valor pago (incluindo entrega e montagem) seja efetuado de imediato, e para que a conduta da loja seja devidamente registada.
