Devolução encomenda não recebida

Exmos Srs. Comprei um sofá no passado dia 22 de Fevereiro na loja de Oeiras e, estando em processo de mudança de casa pedi para a entrega ser agendada para o início de Setembro. Contactaram-me da loja e marcaram a entrega para dia 22 de setembro. No dia 21 liguei para a loja por forma a confirmar a entrega e foi-me dito que dia 22 era o dia da expedição e que seria contactado pela transportadora até 4.ª feira ( dia 24). No dia 24 entrei em contacto com a loja e disseram-me que afinal a data de expedição era dia 23 e para esperar até 6f (dia 26). No sábado (dia 27) desloquei-me à loja e ficaram de me dizer algo na 2f (dia 29). Como não conseguiram dar qualquer informação dia 29 desloquei-me à loja e disse que queria uma resposta até dia 30 ou iria pedir o reembolso, disseram que estava no meu direito. Dia 30 disseram-me que o sofá continuava atrasado e desloquei-me novamente à loja para pedir reembolso. Foi-me dito que por estarmos perto da data de expedição (não realizada) teria de enviar um email para a loja a solicitar o reembolso do dinheiro que me é devido. Para além disso disseram-me que por ter feito a alteração de morada e me ter sido emitida nova fatura o dinheiro não seria devolvido de imediato para o meu cartão mas sim através de transferência bancária o que poderia atrasar o processo. No dia 30 de setembro enviei email com a fatura original e com a nova fatura que me emitiram em agosto, bem como com a indicação do meu IBAN, passaram 2 dias e não recebi qualquer feedback relativo à devolução do meu dinheiro. Solicito a devolução do valor que me é devido de forma célere, sendo que o mesmo deveria ter sido restituído no próprio dia quando fui à loja cancelar a encomenda, dado o vosso incumprimento. Eu já falei com a loja de Oeiras que disse que teria de encaminhar para vocês (central) o pedido de reembolso pelo que calculo que a bola esteja do vosso lado. 918447013 - qualquer horário.

Entrei em contacto com a loja onde comprei o sofá que não me foi entregue. Foi-me dito que no escritório já receberam o pedido e que “em princípio” a transferência será processada para a semana. Solicito que me indiquem a data efetiva da transferência, um “em princípio” não é suficiente. “Em principio” recebia o sofá dia 22 de setembro. Depois “em princípio” até dia 24 seria contactado pela transportadora. No dia 24 afinal já só seria contactado “em princípio” até dia 26. Nunca cheguei a ser contactado. Dia 30 pedi o reembolso de um produto que não me foi entregue e não me parece razoável que “em princípio” receba o valor na minha conta passadas 2 semanas. Se os vossos escritórios já têm conhecimento da situação desde dia 30 basta cancelar a encomenda e efetuar uma transferência… demora 1/2 dias úteis a estar na conta do cliente. Questiono-me se o Gato Preto tem realmente a intenção de devolver o dinheiro que nos é devido. Peço a vossa ajuda para uma rápida resolução deste tema sendo que estou sem sofá e sem o dinheiro para adquirir um. Obrigado pela atenção.

A encomenda está cancelada e o reembolso por transferência está em processamento. Ontem enviámos nota interna ao Departamento Financeiro a priorizar esta transferência. Boa tarde, Começo a perder a paciência com o gato preto. No dia 30 não me fizeram o reembolso do valor no meu cartão conforme combinado na minha visita à loja no dia anterior. Disseram que o valor seria devolvido por transferência bancária e que no máximo dos máximos em 10 dias teria o valor que me é devido na minha conta (como se fosse aceitável eu ter de esperar 10 dias por dinheiro que é MEU, não é nosso)!! Faz hoje 9 dias desde que fiz o meu pedido na sequência do vosso incumprimento. Ainda não recebi o dinheiro na minha conta nem o comprovativo de transferência. Para o dinheiro estar amanhã na minha conta a transferência tem de ser feita hoje. Onde está o comprovativo da transferência e onde está o dinheiro que a loja do gato preto me deve? Exijo a restituição imediata do valor que me pertence!!!

De acordo com a legislação europeia aplicável, o reembolso deve ser efetuado no prazo máximo de 14 dias corridos a contar da data em que nos facultou os dados necessários ao processamento. No seu caso, a contagem iniciou-se em 30/09/2025, pelo que o prazo máximo termina em 14/10/2025. O pedido já foi encaminhado ao nosso Departamento Financeiro para emissão da transferência. É lamentável que uma loja com a dimensão do Gato Preto se agarre aos prazos estabelecidos pela legislação de defesa do consumidor quando não cumpre com o contratado relativamente a uma encomenda efetuada em Fevereiro, para além disso, em loja, foi-me dito que recebia o dinheiro no máximo em 10 dias e não 14 (mais uma mentira entre tantas outras ao longo do processo). Uma empresa séria e que se preocupasse com os seus clientes, uma vez que se encontra em incumprimento efetuaria a transferência na hora. Ficarei então a aguardar novidades da vossa parte.
