Atraso na entrega do sofá BLOOM

Exmos. Senhores, Em 11/8/2025 adquiri um sofá BLOOM, pelo valor de 729,39€, incluindo entrega e montagem. O pagamento foi efetuado no momento. Conforme fatura-recibo, na altura foi acordado com o vendedor que a entrega seria efetuada entre 2 a 4 semanas. Contudo, até à presente data, o mesmo ainda não foi entregue. Apenas me informaram, no dia 1/09/2025 que iria sofrer um atraso de 10 dias úteis. Hoje é dia 26 de setembro, estamos quase no mês de outubro e não tenho qualquer informação da vossa parte acerca da entrega do sofá, nem sequer nenhuma atualização do estado na encomenda, sendo que a mesma se encontra no estado "Confirmada" desde o dia da compra. Assim sendo, peço que me indiquem o dia e hora para a entrega do sofá, pois comprei o sofá com a indicação de um prazo máximo de entrega de 4 semanas, que já foi ultrapassado há muito tempo, não cumprindo as condições aquando do momento da compra. Exmos. Senhores, Mais duas semanas de espera não é aceitável para um artigo que foi comprado no dia 11 de agosto e com prazo máximo de entrega de 4 semanas. Estamos a falar de mais do dobro do prazo inicial. Para além disso, o vosso suporte pós venda é, na prática, inexistente uma vez que existem vários números mas nunca atendem o telemóvel, estando na maioria das vezes o número indisponível. Isto deixa o cliente numa situação muito frustrante, nunca sabendo quando o artigo vai ser entregue e, na verdade, se vai mesmo ser entregue. Não estamos a falar de 5€, são várias centenas de euros que estão "empatadas" e à espera de uma resposta rápida. Da minha parte, esta foi a última compra efetuada na vossa loja, das piores experiências de compra que tive até ao momento em lojas de mobiliário. Uma vez que não foi cumprido o prazo estipulado inicialmente para a entrega do sofá, exigo o valor que paguei prontamente para esse efeito - 69,99€ como forma de compensação por todo o atraso e por lesar diretamente os meus direitos enquanto consumidora. Irei aguardar pelo prazo indicado, dia 13 de outubro de 2025, como data limite, sem tolerância, para a entrega do artigo. Cumprimentos.

Senhores, Serve o presente para reiterar que hoje perfazem 13 dias desde que solicitei o reembolso do montante que me é devido, sem que tenha recebido qualquer comprovativo de transferência da vossa parte. Nos termos do Decreto-Lei n.º 24/2014, de 14 de fevereiro, artigo 12.º, n.º 1, relativo aos direitos dos consumidores, o fornecedor dispõe de 14 dias de calendário para efetuar o reembolso: “No prazo de 14 dias a contar da data em que for informado da decisão de resolução do contrato, o fornecedor de bens ou prestador de serviços deve reembolsar o consumidor de todos os pagamentos recebidos, incluindo os custos de entrega do bem nos termos do n.º 2 do artigo 13.º.” Para que o montante esteja creditado na minha conta até amanhã, a transferência deverá ser efetuada ainda hoje. Mais se informa que o n.º 6 do mesmo artigo estabelece expressamente que, caso o prazo legal seja ultrapassado, o fornecedor é obrigado a restituir o valor em dobro, conforme transcrição: “O incumprimento da obrigação de reembolso dentro do prazo previsto no n.º 1 obriga o fornecedor de bens ou prestador de serviços a devolver em dobro, no prazo de 15 dias úteis, os montantes pagos pelo consumidor, sem prejuízo do direito do consumidor a indemnização por danos patrimoniais e não patrimoniais.” Assim, solicito o envio imediato do comprovativo da transferência bancária, sob pena de serem aplicadas as consequências legais decorrentes do incumprimento do referido decreto-lei. Mais informo que foi já solicitado apoio jurídico e que, caso o pagamento não seja comprovado de forma imediata, será instaurada ação judicial para defesa dos meus direitos e ressarcimento integral dos danos causados.
