Atraso na entrega de encomenda

No dia 1 de agosto 2025, efetuei a encomenda nº #5862, referente a um sofá Cotillard, através da loja online do Gato Preto. No dia 14 de agosto, contactei o apoio ao cliente para obter informações sobre o prazo de entrega que apenas estava indicado no site e apenas recebi uma resposta automática que indicava um atraso adicional de 10 dias úteis face ao prazo inicial de 2 a 4 semanas. (em anexo, a resposta automática recebida a 22.08) Desde então, não recebi qualquer comunicação adicional nem me foi indicada uma data concreta de entrega. Não atendem telefones e, através do email online@gatopreto.com já solicitei pela terceira vez uma resposta. Passados mais de dois meses e meio desde a compra, considero esta situação inaceitável, tanto mais que, no momento da encomenda, foi-me confirmada a disponibilidade do artigo em stock e a previsão de entrega era de 2 a 4 semanas. Assim, solicito suporte a DECO para uma resposta imediata e definitiva por parte do Gato Preto com a data exata de entrega ou, em alternativa, o prazo máximo em que a mesma será assegurada. Procederei à abertura de um processo de reclamação junto das entidades competentes incluindo a DECO, o Livro de Reclamações Eletrónico e, se necessário, as autoridades de defesa do consumidor. De acordo com o Decreto-Lei n.º 84/2021, artigos 9.º e 12.º, a falta de entrega do bem dentro do prazo constitui incumprimento contratual, conferindo ao consumidor o direito à resolução do contrato e indemnização por danos que exijo neste preciso momento. Exma. Senhora Ana Maria, Agradeço a resposta, mas não posso aceitá-la nos termos apresentados. No momento da compra, o artigo estava identificado como disponível em stock, com prazo de entrega de 2 a 4 semanas. Já passaram mais de 2 meses e meio, sem qualquer data concreta de entrega, o que constitui incumprimento contratual, nos termos do Decreto-Lei n.º 84/2021. Não aceito que me seja imposta a espera de uma nova produção com prazo de 6 semanas (ou 60 a 75 dias úteis), quando o compromisso inicial foi totalmente diferente. Assim, reitero o seguinte: 1. Exijo a entrega do sofá encomendado num prazo máximo e vinculativo de 10 dias úteis, contados da data desta comunicação. 2. Caso não seja possível, requeiro a resolução imediata do contrato, com reembolso integral e indemnização pelos danos causados, de acordo com a lei. Informo ainda que, se não obtiver resposta adequada no prazo máximo de 5 dias úteis, avançarei com: • reclamação no Livro de Reclamações Eletrónico, • participação à ASAE e Direção-Geral do Consumidor, • bem como nova denúncia através da DECO.
