Atraso entrega da encomenda

Exmos. Senhores, Em 15/07 adquiri um sofá KEEN, pelo valor de 650 euros. O pagamento foi efetuado no momento. Conforme fatura-recibo, na altura foi acordado com o vendedor que a entrega seria efetuada dentro de 4 a 6 semanas. Foi avisado que estava com atraso de 10 dias úteis, contudo até à presente data, o mesmo ainda não foi entregue (sendo que o prazo com o atraso acabou no início de Setembro). Já efetuei vários contactos junto dos vossos serviços e obtive a resposta de que o bem está com grande atraso devido a enorme afluência mas que sairia do armazém a 19/09, e nada recebi, nenhum e-mail. Assim sendo, exijo, no prazo máximo de 8 dias, procedam à entrega do referido sofá sob pena de resolução do contrato, e sem prejuízo do direito de indemnização por eventuais danos causados. Boa noite, Relativamente à vossa proposta dos 5%, esclareço desde já que não vou aceitar, dado que, face à presente situação, não pretendo voltar a realizar compras na vossa loja tão cedo, como acho que percebe que é justificável. O contrato de compra estabelecia uma previsão de entrega de 4 a 6 semanas. Estamos no final de setembro e, após várias tentativas de obter informações, apenas agora me foi comunicado que nem sequer existe previsão de saída do produto do fornecedor. Este incumprimento contratual é bastante grave e lesa diretamente os meus direitos enquanto consumidora, portanto infelizmente não são 5% de desconto que vão resolver a situação. Perante toda esta situação, e as inúmeras queixas que tenho visto, tenho direito a exigir a resolução imediata do contrato e o reembolso integral do valor pago, ou, em alternativa, a exigir o cumprimento com compensação adequada pelos prejuízos causados, e é pela segunda via que vou optar: solicito formalmente que me seja oferecida a entrega e montagem gratuita do sofá como forma de compensação, e que me apresentem com urgência uma data concreta e vinculativa para a entrega.
