Dear Mr. Ailin,
We acknowledge receipt of your complaint concerning the registration and subsequent removal of the domain name kuraclean.pt.
The domain was removed following the data validation procedure established in the.PT Registration Rules. In accordance with Article 9 of those Rules, you were granted a reasonable period of 10 days to correct or complete the information provided. However, despite the clarifications given by .PT, we did not receive, within that period, the required new NIC-handle containing the correct Portuguese information, as per the e-mail exchange maintained.
The validation and verification of domain name registration data are not merely internal requirements imposed by .PT. They arise from the applicable legal framework, including the principle of accuracy of personal data established by the General Data Protection Regulation (GDPR), as well as the specific obligations applicable to top-level domain name registries under the Portuguese legislation transposing the NIS2 Directive.
As the information provided remained incomplete and did not allow the registration data to be duly validated, the domain name was removed pursuant to Articles 9 and 21 of the .PT Registration Rules.
Accordingly, this situation does not constitute a failure by .PT to provide the contracted service. The domain name was duly registered and maintained until its removal became necessary due to the failure to comply with the applicable data-validation requirements. The removal therefore resulted from the enforcement of the terms and conditions governing the registration and maintenance of .pt domain names, which every holder acknowledges and accepts when applying for a domain name registration.
Please note that the registration and subsequent validation and verification procedures involve administrative and human resources and therefore entail costs for .PT, irrespective of whether the domain name is subsequently removed due to the holder’s failure to provide complete and accurate information.
For these reasons, and since the removal resulted from the failure to provide the information required to validate the registration within the period granted for that purpose and comply with .PT 's Terms and Conditions, we will retain one year payment and refund the remainder corresponding to 4 years. Please expect a contact regarding this refund very soon.
